1-Generale

Il nostro obiettivo è quello di servire ogni singolo cliente in modo che sia pienamente soddisfatto. A questo contribuiscono anche le nostre ottime condizioni generali di contratto.

Il contratto si conclude con l'accettazione da parte nostra della proposta di contratto presentata dal cliente con la sua ordinazione. L'accettazione avviene con la nostra conferma dell'ordine che contiene gli elementi principali dell'ordinazione.

Quando si effettua un ordine il cliente accetta di essere vincolato dai termini e dalle condizioni. In caso di domande riguardo alle nostre condizioni generali si prega di rivolgersi a info@sellwine.ch.

2- Nessuna vendita ai minori

La SellWine Sagl non vende vini o alcolici ai minori di 18 anni. Effettuando un ordine su www.sellwine.ch si conferma di avere l'età legale. Se si richiede l’invio ad una terza persona si conferma al momento dell’ordine che chi ritira l’invio ha l’età legale.

3-Area di mercato

L'intera gamma di www.sellwine.ch è destinato esclusivamente ad una clientela in Svizzera.

Per spedizioni all’estero contattare info@sellwine.ch e segnaliamo che attualmente le spedizioni sono possibili solo verso le aziende.

4-Protezione dei dati

Sellwine.ch registra solo i dati indispensabili che vengono utilizzati per l'esecuzione dell'ordine e per agevolare il più possibile ai clienti abituali i loro acquisiti successivi. 6-Pagamento e consegna

Su www.sellwine.ch sono disponibili diversi metodi di pagamento.
Carte di credito (VISA; MASTERCARD), TWINT, Cripto valute
La consegna è per il proprietario della carta al suo indirizzo o presso un indirizzo di consegna prescelto in Svizzera. Le consegne a più destinatari richiedono diversi ordini individuali.

7- Spese di spedizione

Le spese di spedizione vanno in base al peso delle bottiglie che potrete visualizzare in fase di ordine.

Da 1 a 5 bottiglie CHF 18 / Da 6 bottiglie CHF 0 (spese di spedizione gratuite)

8-Condizioni di consegna

I prodotti disponibili immediatamente vengono consegnati a seconda dell'ora di ricevimento dell'ordine al nostro servizio di recapito il giorno lavorativo stesso o quello successivo. Si tratta di tempi medi che possono tuttavia subire variazioni in caso di problemi di consegna da parte dell'industria.
Per consegnare i prodotti il più rapidamente possibile effettuiamo anche delle consegne parziali. Non vengono applicate spese aggiuntive.
In caso di ordini misti non possiamo garantire la consegna contemporanea di tutti i prodotti.
Per i prodotti disponibili in quantità limitate e per le offerte speciali ci riserviamo la possibilità di stipulare contratti solo per quantità conformi all'uso domestico.

9-Disponibilità

La nostra gamma di prodotti è in continua evoluzione, non garantiamo la disponibilità ininterrotta delle offerte indicate su www.sellwine.ch. Se un prodotto in particolare non è disponibile o lo è in quantità limitata verrete contattati.

10-Conversione / riscatto

Il vostro ordine è vincolante per www.sellwine.ch. Fondamentalmente i prodotti ordinati non possono essere scambiati o restituiti. Viene fatta eccezione per le spedizioni che sono state danneggiate durante il trasporto e/o la consegna. Vi chiediamo di verificare la precisione e l'integrità della consegna e di inoltrare eventuali reclami a noi direttamente nel più breve tempo possibile tramite il modulo di contatto

Dopo 10 giorni dal ricevimento della consegna consideriamo tutto approvato e corretto da parte vostra.

11-Garanzia/Responsabilità

Sono esclusi diritti di annullamento del contratto o di riduzione dell'importo fatturato, fatta eccezione per i seguenti casi:

1. Il vino viene sfortunatamente recapitato danneggiato, avete 10 giorni dal ricevimento per notificarlo e ricevere o un rimborso o la sostituzione, a vostra scelta
2. Il vino sfortunatamente sa di tappo, avete 90 giorni dal ricevimento per notificarlo e ricevere o un rimborso o la sostituzione, a vostra scelta
3. È capitato un disservizio non contemplato nei punti precedenti, avete 90 giorni dal ricevimento per notificarlo e saremo lieti di potervi assistere nel modo migliore. Ciò esclude i vini che hanno superato l’età di godimento consigliata.

La notifica avviene tramite il modulo: Politiche di rimborso

12-Foro competente

La nostra attività commerciale si basa esclusivamente sul diritto svizzero. Il foro competente è quello di Torricella-Taverne.

VENDITA BUONI VALORE PER ESPERIENZE IN CANTINA

1. Informazioni generali
SellWine Sagl, Via Rained 16, 6807 Torricella-Taverne, Svizzera, gestisce il sito www.sellwine.ch.

La piattaforma consente l’acquisto di esperienze enoturistiche offerte da cantine terze situate in Svizzera.

2. Ruolo della piattaforma
SellWine Sagl opera esclusivamente come intermediario commerciale tra il cliente e la cantina.

SellWine Sagl non è il prestatore del servizio, che è fornito direttamente dalla cantina.

3. Natura dei prodotti (Voucher)
I prodotti acquistabili sono voucher digitali che danno diritto a partecipare a esperienze enoturistiche.

Il voucher:
- non costituisce prestazione immediata
- è soggetto a disponibilità da parte della cantina
- ha validità indicata al momento dell’acquisto

4. Conclusione del contratto
Con l’acquisto:
- si conclude un contratto tra cliente e SellWine Sagl per l’acquisto del voucher
- si conclude un contratto separato tra cliente e cantina per l’erogazione del servizio

5. Prezzi e pagamenti
I prezzi sono espressi in CHF.

SellWine Sagl incassa il pagamento per conto della cantina.

6. IVA 
I voucher sono qualificati come buoni valore.
L’IVA non è applicata al momento dell’acquisto del voucher, ma al momento dell’erogazione del servizio da parte della cantina.

7. Prenotazione
La prenotazione dell’esperienza è soggetta a disponibilità della cantina e deve essere effettuata secondo le modalità indicate.

8. Cancellazioni
Salvo diversa indicazione:
- non rimborsabile

9. Responsabilità
La cantina è responsabile per l’erogazione del servizio.

SellWine Sagl non è responsabile per eventuali disservizi o danni derivanti dall’esperienza.

10. Documentazione fiscale
Su richiesta, la cantina può emettere fattura al cliente.

La fattura potrà indicare che il pagamento è stato effettuato tramite SellWine Sagl.

11. Protezione dei dati
I dati personali sono trattati conformemente alla normativa svizzera sulla protezione dei dati.

12. Legge applicabile e foro
Il presente contratto è disciplinato dal diritto svizzero. Per qualsiasi controversia è competente in via esclusiva il foro di Torricella-Taverne , salvo disposizioni imperative di legge.

1-General
We strive to serve all of our customers to their utmost satisfaction at all times. This includes our fair terms and conditions of business.

The contract is concluded in that we accept, through our order confirmation, the customer's offer to enter into a contract by way of placing an order. This order confirmation includes the material content of the order placed.

When making an order customers agree to be bound by all terms and conditions. Any questions concerning our terms and conditions of business should be addressed to info@sellwine.ch.

2- No sales to minors
SellWine Sagl does not sell wines or spirits to anyone under the age of 18. Making an order on www.sellwine.ch is confirmation that the purchaser is of legal age. When you require the delivery to a third party you confirm that the recipient is of legal age.

3-Markets served
The entire range of www.sellwine.ch products is destined exclusively for clients in Switzerland.

For shipments abroad please contact info@sellwine.ch and we point out that currently shipments are only possible for companies.

4-Data Protection/Privacy
Sellwine.ch only records essential data and uses these within the scope of order processing as well as for the purpose of making shopping as simple as possible for regular customers.

Personal data will be treated as confidential and will not be passed on to third parties for advertising purposes, in line with data protection legislation.

We keep outstanding and completed orders on file. In order to offer the best possible options for the choice of payment mode, we have to safeguard the customers and ourselves against improper use.

Depending on the time of receipt of the order, immediately available products will be handed over to our delivery service on the same day or the next working day. These are typical times which may, however, vary in the event of supply shortages in the industry.

In order to deliver the products as quickly as possible, we may make part deliveries. This will not involve any additional expense.

In the case of mixed orders, we are unable to guarantee simultaneous delivery of the products.
We reserve the right to limit orders to consumer quantities in the case of products in short supply and special offers.

9- Availability
We are constantly developing our product range, and we cannot guarantee the uninterrupted availability of the offers shown on www.sellwine.ch. If a particular product is not available, or is only available in limited quantities, we will contact you.

10- Deliveries damaged
Your order is held to be binding by www.sellwine.ch. Fundamentally, the products ordered cannot exchanged or returned. An exception will be made for deliveries damaged in transit. Please check the accuracy and condition of your delivery and address any claims directly to us as soon as possible using our contact form.

Ten days after you have received the delivery we will consider everything as correct and approved by you.

11-Warranty/Liability

Claims for rescission of contract or reduction in payment will not be considered, but  exception is made for the following cases:

1. The wine is unfortunately delivered damaged, you have 10 days from the reception to notify and receive or a refund or a replacement delivery, of your choice.

1. The wine unfortunately tastes of cork, you have 90 days from the reception to notify and receive or a refund or a replacement delivery, of your choice.

1. There has been an inefficency not covered in the previous points, you have 90 days from the reception to notify it and we will be happy to assist you in the best way. This excludes wines that have exceeded the recommended age of taste.

The notification is made through the form: refund policies.  

12-Place of Jurisdiction
Our business activities are based exclusively on Swiss law. The place of jurisdiction is 6807 Torricella-Taverne, Switzerland.

SALE OF VALUE VOUCHERS FOR WINERY EXPERIENCES

1. General Information
SellWine Sagl, Via Rained 16, 6807 Torricella-Taverne, Switzerland, operates the website www.sellwine.ch.

The platform allows the purchase of wine tourism experiences offered by third-party wineries located in Switzerland.

2. Role of the Platform
SellWine Sagl acts exclusively as a commercial intermediary between the customer and the winery.

SellWine Sagl is not the provider of the service, which is delivered directly by the winery.

3. Nature of the Products (Vouchers)
The products available for purchase are digital vouchers that grant the right to participate in wine tourism experiences.

The voucher:
- does not constitute an immediate service
- is subject to availability by the winery
- has a validity period indicated at the time of purchase

4. Conclusion of the Contract
Upon purchase:
- a contract is concluded between the customer and SellWine Sagl for the purchase of the voucher
- a separate contract is concluded between the customer and the winery for the provision of the service

5. Prices and Payments
Prices are expressed in CHF.

SellWine Sagl collects the payment on behalf of the winery.

6. VAT
The vouchers are classified as value vouchers.

VAT is not applied at the time of purchase of the voucher, but at the time of the provision of the service by the winery.

7. Booking
Booking of the experience is subject to availability of the winery and must be made according to the indicated procedures.

8. Cancellation
Unless otherwise specified:
- non-refundable

9. Liability
The winery is responsible for the provision of the service.

SellWine Sagl is not responsible for any disruptions or damages arising from the experience.

10. Tax Documentation
Upon request, the winery may issue an invoice to the customer.

The invoice may indicate that the payment has been made via SellWine Sagl.

11. Data Protection
Personal data is processed in accordance with Swiss data protection regulations.

12. Governing Law and Jurisdiction
This agreement is governed by Swiss law.

For any dispute, the exclusive place of jurisdiction is Torricella-Taverne, subject to mandatory legal provisions.

SellWine Sagl ne vend pas de vins ou de boissons alcoolisées aux mineurs de moins de 18 ans. Toute personne passant une commande sur www.sellwine.ch doit confirmer d’avoir l’âge légal. En cas de demande d’envoi à une tierce personne, il convient de confirmer au moment de la commande que la personne qui réceptionnera l’envoi a bien l’âge légal.

3-Marché
Toute la gamme de www.sellwine.ch est destinée exclusivement à une clientèle basée en Suisse.

Pour les livraisons à l’étranger, contacter info@sellwine.ch et nous attirons votre attention sur le fait qu'à l'heure actuelle, les expéditions ne sont possibles que pour les entreprises.

Sur www.sellwine.ch, différentes méthodes de paiement sont disponibles.

La livraison s’effectue pour le propriétaire de la carte à son adresse ou à une adresse de livraison présélectionnée en Suisse. Les livraisons à plusieurs destinataires exigent des commandes individuelles différentes.

7- Frais d’envoi 

Les frais d'expédition sont basés sur le poids des bouteilles, que vous pouvez voir lors de la commande.
8-Conditions de livraison
Les produits immédiatement disponibles sont livrés selon l’heure de réception de la commande à notre service de distribution le jour ouvré même ou le suivant. Il s’agit là de durées moyennes qui peuvent toutefois subir des variations en cas de problèmes de livraison dus au transporteur.

Pour livrer les produits le plus rapidement possible, nous effectuons également des livraisons partielles. Aucun surcoût n’est appliqué.
En cas de commandes mixtes, nous ne pouvons pas garantir la livraison simultanée de tous les produits.
Pour les produits disponibles en quantités limitées et pour les offres spéciales, nous nous réservons le droit de stipuler des contrats exclusivement pour des quantités conformes à l’usage domestique.

9-Disponibilités
Notre gamme de produits évoluant constamment, nous ne garantissons pas la disponibilité interrompue des offres figurant sur www.sellwine.ch. Si un produit en particulier n’est pas disponible ou l’est en quantité limitée, vous serez contacté.

10-Conversion / remboursement
Votre commande est ferme pour www.sellwine.ch. En principe, les produits commandés ne peuvent pas être échangés ou retournés. Les articles qui ont été endommagés pendant le transport et/ou la livraison sont une exception à cette règle. Nous vous demandons de vérifier l’exactitude et l’intégrité de la livraison et de nous communiquer directement d’éventuelles réclamations le plus rapidement possible par l’intermédiaire du formulaire de contact (lien)

10 jours après la réception de la livraison, nous considérons que tout a été approuvé et considéré comme correct de votre part.

11-Garantie/Responsabilité.
Les droits d’annulation du contrat ou de réduction du montant facturé sont exclus, à l’exception des cas suivants :

1. Le vin est malheureusement livré endommagé. Vous avez 10 jours après la réception pour nous le signaler afin de bénéficier d’un remboursement ou d’un remplacement, à votre convenance

1. Un dysfonctionnement non prévu par les points précédent est survenu. Vous avez 90 jours après la réception pour nous le signaler. Nous serons heureux de pouvoir vous aider de la meilleure manière possible. Cela exclut les vins qui ont dépassé la date limite de consommation conseillée.

Le signalement doit se faire à l’aide du formulaire: Politiques de remboursement

12-Juridiction compétente
Notre activité commerciale se base exclusivement sur le droit suisse. La juridiction compétente est celle de Torricella-Taverne.

VENTE DE BONS DE VALEUR POUR EXPÉRIENCES EN CAVE

1. Informations générales

La plateforme permet l’achat d’expériences œnotouristiques proposées par des caves tierces situées en Suisse.

2. Rôle de la plateforme
SellWine Sagl agit exclusivement en tant qu’intermédiaire commercial entre le client et la cave.

SellWine Sagl n’est pas le prestataire du service, lequel est fourni directement par la cave.

3. Nature des produits (bons)
Les produits disponibles à l’achat sont des bons numériques donnant droit à participer à des expériences œnotouristiques.

Le bon :
- ne constitue pas une prestation immédiate
- est soumis à la disponibilité de la cave
- a une durée de validité indiquée au moment de l’achat

4. Conclusion du contrat
Lors de l’achat :
- un contrat est conclu entre le client et SellWine Sagl pour l’achat du bon
- un contrat distinct est conclu entre le client et la cave pour la fourniture du service

5. Prix et paiements
Les prix sont exprimés en CHF.

SellWine Sagl encaisse le paiement pour le compte de la cave.

6. TVA
Les bons sont qualifiés comme bons de valeur.

La TVA n’est pas appliquée au moment de l’achat du bon, mais au moment de la fourniture du service par la cave.

7. Réservation
La réservation de l’expérience est soumise à la disponibilité de la cave et doit être effectuée selon les modalités indiquées.

8. Annulation
Sauf indication contraire :
- non remboursable

9. Responsabilité
La cave est responsable de la fourniture du service.

SellWine Sagl n’est pas responsable d’éventuels dysfonctionnements ou dommages résultant de l’expérience.

10. Documentation fiscale
Sur demande, la cave peut émettre une facture au client.

La facture peut indiquer que le paiement a été effectué via SellWine Sagl.

11. Protection des données

2- Kein Verkauf an Minderjährige

SellWine Sagl verkauft keine Weine oder Alkohol an Minderjährige unter 18 Jahren. Mit der Bestellung auf www.sellwine.ch bestätigen Sie, dass Sie volljährig sind. Wenn die Bestellung an eine dritte Person zu senden ist, wird zum Zeitpunkt der Bestellung bestätigt, dass derjenige, der die Sendung bezieht, volljährig ist.

3-Marktbereich

6-Zahlung und Lieferung
Auf www.sellwine.ch sind verschiedene Zahlungsmodi verfügbar.
Die Auslieferung erfolgt erst nach Eingang der Zahlung durch: Kreditkarte (MasterCard, Visa), TWINT, Kryptowährungen

Die Lieferung erfolgt an den Besitzer der Karte, an seine Adresse oder an eine gewählte Lieferadresse in der Schweiz. Lieferungen an mehrere Empfänger bedingen verschiedene, individuelle Bestellungen.

7- Versandspesen
Die Versandkosten richten sich nach dem Gewicht der Flaschen, das Sie bei der Bestellung sehen können.

1 bis 5 Flaschen CHF 18 / Ab 6 Flaschen CHF 0 (versandkostenfrei)

8-Lieferbedingungen
Sofort verfügbare Produkte werden, je nach Tageszeit des Eingangs der Bestellung bei unserem Zustelldienst, gleichentags oder am Tag darauf ausgeliefert. Es handelt sich um Durchschnittszeiten, die, im Fall von Lieferproblemen seitens des Gewerbes, variieren können.
Um die Produkte so schnell wie möglich auszuliefern, können auch Teillieferungen erfolgen. Daraus entstehen keine Zusatzkosten.
Im Fall von Mischaufträgen können wir die gleichzeitige Lieferung aller Produkte nicht garantieren.
Für Produkte, die nur beschränkt verfügbar sind oder als Spezialofferte angeboten werden, behalten wir uns die Möglichkeit vor, Verträge für Mengen im Rahmen des Hausgebrauchs zu empfehlen.

9-Verfügbarkeit
Unsere Produktepalette ist in ständigem Wandel begriffen; wir können demnach keine ununterbrochene Verfügbarkeit des auf www.sellwine.ch angebotenen Sortiments garantieren. Sollte ein bestimmtes Produkt nicht oder nur in beschränkter Menge verfügbar sein, werden Sie kontaktiert.

10-Umtausch / Rückkauf
Für www.sellwine.ch ist Ihre Bestellung verbindlich. Grundsätzlich können bestellte Produkte weder umgetauscht noch zurückgegeben werden. Eine Ausnahme gilt für Sendungen, die während des Transports und/oder der Lieferung beschädigt wurden. Wir bitten Sie, die Richtigkeit und Vollständigkeit der Lieferung zu überprüfen und Beschwerden über das Kontaktformular direkt an uns in kürzester Zeit weiterzuleiten
Nach zwei 10 Tagen ab Erhalt der Lieferung betrachten wir alles als genehmigt und korrigiert von Ihnen.

11-Garantie/Haftung
Die Rechte zum Rücktritt vom Vertrag oder zur Herabsetzung des Rechnungsbetrages sind ausgeschlossen, mit Ausnahme der folgenden Fälle:
Wenn der Wein leider beschädigt geliefert wird, haben Sie 10 Tage ab Erhalt Zeit, um uns dies mitzuteilen; Sie erhalten nach Ihrer Wahl das Geld zurück oder einwandfreie Ware.

Wenn der Wein leider nach Kork schmeckt, haben Sie 90 Tage ab Erhalt Zeit, um uns dies mitzuteilen; Sie erhalten nach Ihrer Wahl das Geld zurück oder einwandfreie Ware.

Wenn ein anderer Fehler eingetreten ist, haben Sie 90 Tage Zeit, uns dies mitzuteilen und wir tun unser Bestes, um Ihnen zu helfen. Ausgenommen sind Weine, die das empfohlene Alter für den Konsum überschritten haben.

12-Gerichtsstand
Unsere geschäftliche Aktivität beruht ausschliesslich auf Schweizer Recht. Gerichtsstand ist Torricella-Taverne.

VERKAUF VON WERTGUTSCHEINEN FÜR WEINGUT-ERLEBNISSE

1. Allgemeine Informationen
SellWine Sagl, Via Rained 16, 6807 Torricella-Taverne, Schweiz, betreibt die Website www.sellwine.ch.

Die Plattform ermöglicht den Kauf von Weintourismus-Erlebnissen, die von dritten Weingütern in der Schweiz angeboten werden.

2. Rolle der Plattform
SellWine Sagl handelt ausschließlich als kommerzieller Vermittler zwischen dem Kunden und dem Weingut.

SellWine Sagl ist nicht der Anbieter der Dienstleistung, welche direkt vom Weingut erbracht wird.

3. Art der Produkte (Gutscheine)
Die angebotenen Produkte sind digitale Gutscheine, die zur Teilnahme an Weintourismus-Erlebnissen berechtigen.

Der Gutschein:
- stellt keine unmittelbare Leistung dar
- ist abhängig von der Verfügbarkeit des Weinguts
- hat eine beim Kauf angegebene Gültigkeitsdauer

4. Vertragsabschluss
Mit dem Kauf:
- kommt ein Vertrag zwischen dem Kunden und SellWine Sagl über den Erwerb des Gutscheins zustande
- kommt ein separater Vertrag zwischen dem Kunden und dem Weingut über die Erbringung der Dienstleistung zustande

5. Preise und Zahlungen
Die Preise sind in CHF angegeben.

SellWine Sagl zieht die Zahlung im Namen des Weinguts ein.

6. Mehrwertsteuer (MWST)
Die Gutscheine gelten als Wertgutscheine.

Die MWST wird nicht beim Kauf, sondern bei der Erbringung der Dienstleistung durch das Weingut erhoben.

7. Buchung
Die Buchung des Erlebnisses ist abhängig von der Verfügbarkeit des Weinguts und erfolgt gemäß den angegebenen Modalitäten.

8. Stornierung
Sofern nicht anders angegeben:
- keine Rückerstattung

9. Haftung
Das Weingut ist für die Erbringung der Dienstleistung verantwortlich.

SellWine Sagl haftet nicht für etwaige Störungen oder Schäden, die aus dem Erlebnis entstehen.

10. Rechnungsstellung
Auf Anfrage kann das Weingut dem Kunden eine Rechnung ausstellen.

Die Rechnung kann den Hinweis enthalten, dass die Zahlung über SellWine Sagl erfolgt ist.

11. Datenschutz
Die personenbezogenen Daten werden gemäß den schweizerischen Datenschutzbestimmungen verarbeitet.

12. Anwendbares Recht und Gerichtsstand
Dieser Vertrag unterliegt dem schweizerischen Recht.

Für alle Streitigkeiten ist der Gerichtsstand Torricella-Taverne, vorbehaltlich zwingender gesetzlicher Bestimmungen.
